The man accused in the deadly Colorado theater shootings wants to change his plea to not guilty by reason of insanity, his lawyers said Tuesday.

Attorneys for James Holmes said in a court filing they plan to formally ask for the change of plea at a May 13 hearing.

A judge in the case previously entered a standard not guilty plea for the 25-year-old Holmes. If the judge accepts the new plea, Holmes would be sent to the state mental hospital, where doctors would determine whether he was insane at the time of the July 20 shootings.

The decision – disclosed in court just days after prosecutors publicly rejected Holmes’ offer to plead guilty if they took the death penalty off the table – elevated the already sensational case to a new level and could cause it to drag on for years.

For the first time with hair that’s brown instead of a wild shade of orangish-red, the suspect in Colorado’s movie theater shooting appeared in court Thursday as prosecutors gave up their fight to see a notebook he sent to a university psychiatrist, saying they didn’t want to delay proceedings.

Holmes appeared more animated during the hearing. He smiled and glanced around the courtroom, looking at his lawyers and reporters covering the hearing. He appeared to be moving his mouth but not actually talking.

As the suspected gunman in the Colorado theater massacre heads to his first court appearance Monday, authorities have disclosed that he is refusing to cooperate and that it could take months to learn what prompted the horrific attack on midnight moviegoers at a Batman film premiere.

James Holmes has been held in solitary confinement at an Arapahoe County detention facility since Friday but will be moved to a nearby courtroom for a 9:30 a.m. MDT hearing, where he will hear the pending charges against him. Holmes is being held on suspicion of first-degree murder, and he could also face additional counts of aggravated assault and weapons violations.

Authorities on Saturday began disarming trip wires and explosive devices “set up to kill” inside the apartment of the suspect in the deadly Colorado movie theater shooting, hoping to find clues to his motive without destroying key evidence in a blast.

Federal authorities detonated one small explosive and disarmed another inside James Holmes’ suburban Denver apartment with a device that emits a shock wave and water, a law enforcement official told The Associated Press. The official spoke on condition of anonymity, citing the ongoing investigation into the shooting rampage that killed 12 people and wounded 58.

The suspect in a shooting that killed or wounded 71 people early Friday in a suburban Denver movie theater is not talking to investigators, a law enforcement official briefed on the investigation told The Associated Press.

The official spoke on condition of anonymity in discussing the ongoing case. The person also said police found jars of chemicals in James Holmes’ booby trapped Aurora apartment with wires nearby.

The Paris premiere of the new Batman movie “The Dark Knight Rises” was canceled Friday after a gunman killed at least a dozen people at a Colorado opening of the same film.

The event at a movie theater on the French capital’s famed Champs-Elysees Avenue was supposed to include director Christopher Nolan and stars like Christian Bale, Anne Hathaway, Morgan Freeman and Michael Caine.

But on Friday afternoon, workers were pulling down the red carpet display. Some could be seen carrying away a large mask that had adorned the facade of the theater.
